Engineering and construction insurance

The engineering insurance sector is comprised of several classes of insurance including: machinery breakdown insurance, electronic equipment insurance, construction equipment insurance, computer and database insurance, contractors all risks insurance and erection all risks insurance. The common denominator of all of the aforementioned classes of insurance is the technical and engineering aspect which characterises the inherent insurance risks.

Insurance risk management

Risk management is a process which involves ascertaining the current situation in any given business, identifying weak spots which are liable to give rise to damages / malfunctions (“the risks”) and suggests solutions to prevent or mitigate these risks. An adequate and professional insurance portfolio is one of the most important risks solutions.

Professional indemnity insurance for the real estate and construction industry
Until around ten years ago, professional indemnity insurance was usually only available to freelance professionals such as architects, engineers, lawyers, accountants, doctors etc. In the last few years, due to the increased consumer awareness and advances in the insurance industry in Israel, there is an increasing demand for professional indemnity insurance for various industries including construction and real estate. It is now possible to arrange professional indemnity insurance for shopping centre managers, hotel managers, building contractors as well as earthwork and infrastructure contractors. The demand for this type of insurance has become essential in commercial dealings with regulatory entities and major commercial entities.

Professional mediation proceedings for insurance disputes
Insurance programs / insurance policies / insurance specifications are full of complex wordings and unique definitions whose ramifications are only fully understood by people handling them on a day-to-day basis. Disputes regarding insurance cover between insurers and insureds which are brought to court after many years will in many cases be referred to a compromise or mediation proceeding after amicable relations between the parties have broken down and they are no longer working together. Commencing a mediation process to deal with insurance conflicts with the assistance of insurance professionals in the early stages of the conflict may well enable the problem to be solved within a short period of time in an optimal manner and thereby enable the parties to continue to conduct business relations.

Products liability insurance for the construction and infrastructure industry
The Defective Products Law - 1980 which places strict liability on manufacturers, explicitly clarifies that a “product” includes “a product which is connected to the ground and a building”. The practical implication of this definition is that a contractor which constructs buildings, building parts, improvements to buildings, infrastructures, bridges and the like is a “manufacturer” and is hence exposed to liability in accordance with this law. The lecture will address the various rules and their implications.
